Understanding Compensation for Medication Side Effects

February 22, 2024 by Pam Maynard

What Compensation Might You Be Entitled to If You’re Harmed by the Side Effects of a Medicine?

The vast majority of medicines are safe. But sometimes, medicines on the market actually hinder rather than help. Yep, unfortunately, some cause serious, unexpected medication side effects.

If that should happen to you, then at least you may have the opportunity to seek compensation by filing a lawsuit. So, let’s take a look at what compensation you might be entitled to if you’re harmed by the side effects of a medicine.

Examples of Medicines with Nasty Side Effects

While all medicines come with potential minor side effects that are listed on the packet or the accompanying pamphlet, some medicines cause unexpected serious side effects. Indeed, over the decades, many manufacturers of certain medicines have found themselves facing lawsuits as a consequence.

Recent examples include Zantac, which was a popular antacid medication used to nix heartburn and stomach ulcers until it got yanked off shelves due to concerns about it containing a cancer-risk-raising impurity. This led to a boatload of lawsuits and eventually pull-outs from the market.

Then there was Elmiron, which was prescribed for bladder pain but turned out to be a bit of an eye-opener — in a bad way. Reports started rolling in about possible retina damage leading to vision problems, cueing users to start legal action.

And numerous Ozempic lawsuits are happening right now. Ozempic, which is a medication used by obese people to help them lose weight, has been proven to cause severe gallbladder and gastrointestinal problems – in addition to Wegovy and other similar drugs.

If you have been affected yourself and want to file an Ozempic Lawsuit, make sure you consult a reputable product liability lawyer who has the experience and excellence to assist you in gaining the compensation you deserve.

Now, let’s explore the types of compensation that you might be eligible for.

Medical Bills Coverage

When medication side effects throw you a nasty curveball, medical bill coverage comes into play as part of compensation. It’s there to tackle costs for hospital stays, doctor visits, treatments, and any meds that help you claw back to health.

The idea is your bank account shouldn’t take the hit for someone else’s negligence. So, if you’re in this boat, claiming those expenses can help keep you afloat financially while you’re patching yourself up.

Lost Wages

If a med’s side effects have you playing hooky from work, lost wages compensation can help fill the gap in your paycheck. This cash is meant to make up for the dollars you would’ve pocketed if you’d been clocking in instead of clocking time with doctors.

It’s not just about your current missed moolah, either; if your ability to earn down the line has taken a dive thanks to these unwanted extras from your meds, that should be figured into the mix as well.

Pain and Suffering

Alright, so when medication side effects that wrack your body with pain or turn your life into a rollercoaster of agony, compensation for pain and suffering steps in.

This isn’t about the tangibles like medical bills or lost wages—it’s for the non-stop discomfort and the rough ride your body and mind endure. It acknowledges that not all hurts come with a price tag—you can’t slap a barcode on a grimace or a wince.

Punitive Damages

When punitive damages get awarded, they’re like a cash penalty that you could receive. This isn’t just reimbursement for the bad hand you’ve been dealt; it’s a financial punishment aimed at the drug manufacturer for their very bad conduct.

If deemed that they were seriously out of line — like ignoring safety protocols or hiding risks — then wham! The court can slap them with punitive damages as a way to say, “Don’t even think about doing that again.”

It’s a warning shot to them and others to keep their act clean or face the financial music.
