What to Do if You Have a Slip-and-Fall Accident While Out With Your Kids

October 21, 2022 by Pam Maynard

Children are easily excitable and restless. When they’re not running, they are jumping and playing, making it easy for them to be involved in slip-and-fall accidents.

Sometimes, kids fall because they are running too fast, playing rough, or are generally distracted, and sometimes these falls are not the fault of the kids.

By law, property owners must maintain a safe environment and warn people, both adults, and children, of potential risks. However, children can be resilient and end up being hurt in an accident.

On that note, here are some things you should do if you are involved in a slip-and-fall accident while out with your kids.

Get Medical Attention

The first thing to do when involved in an accident is to get medical attention for accurate diagnosis and follow-up with treatment. Your health or that of your kid should be your priority.

Statistics show that head injuries among kids are caused mainly by falls, and as much as 50 % of traumatic brain injuries happen through slip and fall accidents.

As a result of slips and falls, one is prone to traumatic brain injuries, which can change your kid’s life, leading to seizures and permanent or severe neurological disorders such as paralysis or even death.

Don’t wait to see if the pain will go away after a while as this can be dangerous and a disadvantage because insurance companies will argue that since you waited, then you must have not been injured.

Seeking medical attention is also essential for documentation and can act as evidence In case you decide to seek compensation for your injuries.

Contact An Expert Lawyer

When you slip and fall on someone else’s property, you can protect your legal rights by contacting an expert injury lawyer with years of experience like Wieand Law.

Many slip-and-fall cases are complex and difficult to prove, so it is important to seek help from an experienced law firm that will handle the confusing paperwork while you focus on recovering.

These professionals help you understand your legal rights, ensure you follow specific guidelines to protect your rights and help you with receiving compensation.

Make A Report

It is best to report the accident in a residential area as soon as it happens to the property owner or landlord. And if it’s in a business establishment, the fall should be reported to the manager or supervisor when it occurs.

Accidents can occur anywhere kids are being kids without adult supervision.

This creates a record of the accident and notifies the company or property owner of any slip and fall case you might present concerning compensation for injuries and damages caused.

Avoid making recorded statements because some insurance adjusters are experienced in asking questions in a way that minimizes the level of pain or severity of your injuries.

You should also remember to ask for details of the incident in writing. The property owner should give you a written report and a copy before you leave the property.

Take Pictures Of The Accident Scene

It is essential to take pictures and videos of the accident scene and, if possible, get the contact information of those in the area who witnessed the fall.

If it wasn’t possible to take pictures at the time of the accident, you can ask a family or friend to take as many photos and videos as possible.

If this is delayed, and the fall results from neglect on the property owner’s part, they can make repairs where necessary, making evidence challenging to collect.

Any picture or video proving that the building or area where the accident occurred was a result of negligence will help you protect your legal rights.
